Contractual Relationship
These General Terms of Use ("Terms" or "Agreement") govern your access to and use of the mobile applications, websites, content, products, and services (collectively, the "Platform") made available by Mytouch Icon Automation LLP, a Limited Liability Partnership incorporated in India ("Oolalala", "We", "Us", or "Our").
This document is an electronic record in terms of the Information Technology Act, 2000, and does not require any physical or digital signatures. These Terms expressly supersede any prior agreements or arrangements with you.
Services & Business Model
2.1 Nature of Service
Oolalala is a technology aggregator — a digital marketplace that connects independent third-party providers of transportation services ("Drivers") with individuals seeking such services ("Passengers").
2.2 Independence of Drivers
- All transportation services are provided by independent Drivers who are not employed by Oolalala.
- The contract for the actual transportation is formed solely between the Passenger and the Driver. Oolalala is not a party to that specific transportation agreement.
2.3 RCS Onboarding & Promotional Consent
By submitting your information on our website during RCS onboarding, you consent to receive promotional communications from Oolalala via RCS, SMS, Voice calls, and WhatsApp. You may opt out of marketing communications at any time via App settings.
User Accounts & Eligibility
3.1 Eligibility
To use the Platform, you must be at least 18 years of age and capable of entering into a binding contract under Indian law.
3.2 Registration
You must register for and maintain an active personal user account ("Account"). You agree to:
- Provide accurate, current, and complete information (name, mobile number, etc.).
- Maintain the security and confidentiality of your login credentials (OTP / Password).
- Notify us immediately of any unauthorized use of your Account.
3.3 One Account Policy
Users are limited to one account. Creating multiple accounts to abuse promotional codes, bypass suspensions, or commit fraud is strictly prohibited and will result in a permanent ban.
Financial Terms
4.1 All-Inclusive Fare
The fare negotiated and agreed upon via the App is all-inclusive — it covers the base fare, applicable taxes, toll charges, parking fees, and state entry taxes (if applicable). Drivers are responsible for paying any tolls or fees out of the agreed fare. Passengers shall not be asked to pay extra unless specifically renegotiated within the App due to a change in route or destination.
4.2 Service & Platform Fees
- Passengers (Platform Fee): A "Platform Fee" is charged for the use of the Oolalala app and its technology services. This fee will be displayed before you confirm your booking or added to the final bill.
- Drivers (Service Fee): Drivers pay a commission to Mytouch Icon Automation LLP for every completed ride. This fee is deducted from the Driver's prepaid wallet or collected via other agreed methods.
4.3 Refunds (Driver Wallet)
- If a Driver's account is debited for a ride cancelled by the Passenger (before the driver arrived) or for a Passenger "No Show", the Driver may be eligible for a refund of the Service Fee, subject to verification.
- Upon permanent deletion of a Driver Account, any undisputed unused balance will be refunded to the Driver's bank account within a reasonable timeframe, provided no liabilities remain.
4.4 Cancellation & Waiting Fees
- Cancellation Fee: A fee may be charged if you cancel a trip after a Driver has accepted it and travelled a certain distance, or if you fail to show up within the specified time limit.
- Waiting Fee: If the Driver waits beyond the complimentary waiting period, a Waiting Fee may be added to the final fare.
- Distribution: These fees are generally passed to the Driver to compensate for their time and fuel, less any applicable commission retained by Oolalala.
User Conduct & Rules
By using the Platform, you agree NOT to:
- Violate Laws: Use the Service for any unlawful purpose, including transporting illegal drugs, weapons, or hazardous materials.
- Fraud: Impersonate any person or entity, or falsify details about yourself or your vehicle.
- Harassment: Stalk, threaten, or harass any other User (Driver or Passenger).
- Discrimination: Refuse service or harass anyone based on race, religion, caste, gender, disability, or sexual orientation. Oolalala has a Zero Tolerance Policy regarding discrimination.
- Poaching: Arrange "offline" rides with Users you connected with via Oolalala to bypass Platform Fees.
- Harm the Platform: Reverse engineer, decompile, or disrupt the integrity or performance of the Oolalala App.
5.1 User Reviews & Ratings
You may rate Drivers and submit feedback ("User Content"). You grant Mytouch Icon Automation LLP a perpetual, worldwide, royalty-free license to use, display, and distribute your User Content on the Platform. We reserve the right to remove or edit any content that is offensive, defamatory, or irrelevant. Fake reviews or ratings to manipulate the system are strictly prohibited.
Driver & Passenger Communications
6.1 Respectful Communication
You agree to treat other Users with respect and courtesy. Abusive, profane, defamatory, threatening, or unlawful language in calls, in-app chats, or in person is strictly prohibited.
6.2 Purpose Limitation
Communications via the Platform are strictly for arranging and fulfilling transportation (e.g., clarifying pickup location, recovering lost items). Contact information obtained via the App must not be used for stalking, social networking, or marketing.
6.3 Monitoring
Oolalala reserves the right to monitor, review, and record in-app communications for safety, fraud prevention, regulatory compliance, and customer support purposes.
6.4 Data Privacy
Do not share unnecessary personal information via the App's communication channels. You strictly agree not to disclose or distribute the contact details of any other User to third parties.
Anti-Fraud Policy
7.1 Prohibited Activities
- Collusion: Creating fake rides, cancelling rides to take them offline, or coordinating to artificially spike demand.
- Fake Accounts: Creating multiple accounts to abuse promo codes or bypass bans.
- Incentive Abuse: Creating fake bookings to meet ride-count targets for incentives.
- GPS Spoofing: Using "Mock Location" tools to manipulate real-time location data.
- False Claims: Falsely reporting "No-Shows" to collect cancellation fees.
- App Tampering: Using modified APKs, bots, or scripts to interact with the Platform.
7.2 Consequences
- Immediate Suspension: Account blocked without notice.
- Withholding of Funds: Funds deemed to be proceeds of fraud may be confiscated.
- Legal Action: Civil or criminal proceedings under the Information Technology Act, 2000 and the Indian Penal Code.
Personal Data Protection
By registering and using the Platform, you explicitly consent to Mytouch Icon Automation LLP collecting, using, storing, and processing your Personal Data in accordance with this Agreement and our Privacy Policy.
"Personal Data" includes Identity Data (Name, Gender), Contact Data (Mobile, Email), Verification Data (ID numbers), and Location Data.
Provision of Personal Data is voluntary; however, without necessary data (such as mobile number or location), we will be unable to provide the Services. You may opt out of marketing communications via App settings at any time.
Safety & Verification
9.1 Driver Verification
While we take steps to verify Driver documents (Licence, RC, Insurance), Oolalala cannot guarantee the identity or behaviour of every User. You interact with other Users at your own risk.
9.2 SOS / Emergency Button
The App features an SOS button allowing you to share your ride details with trusted contacts or contact emergency services. We strongly encourage you to use this feature if you feel unsafe.
Intellectual Property
Mytouch Icon Automation LLP owns all rights, title, and interest in and to the Platform, including all intellectual property rights (software, logo, design, database). The Service is protected by copyright, trademark, and other applicable laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device solely for the purpose of obtaining or providing transportation services. You may not copy, modify, distribute, or sell any part of the App.
Driver Agreement (PRIVATE CAR – RIDE SHARING)
This section applies to Drivers using a privately registered vehicle for ride-sharing on the Platform.
11.1 Nature Of Platform
- Oolalala is a technology platform facilitating ride-sharing between individuals.
11.2 Driver Status
- You are not an employee or agent of Oolalala.
- You operate as an independent individual and are not a commercial transport operator.
11.3 Vehicle Use
- Your vehicle must be registered as a private vehicle and used only for ride-sharing.
- You will not operate for commercial profit.
11.4 Cost Sharing
You may only collect contributions towards fuel, tolls, and basic travel expenses. Earning profit is strictly prohibited under this category.
11.5 Legal Compliance
- You must hold a valid driving licence and maintain valid insurance.
- You must comply with the Motor Vehicles Act, 1988.
11.6 Liability
You are solely responsible for driving conduct, passenger safety, and vehicle condition. Oolalala is not liable for any incidents.

11.7 Termination

11.9 Refund & Cancellation Policy

Commercial Taxi Driver Agreement/Operator Agreement
Touch Icon Automation LLP, operating the platform “Oolalala” (hereinafter referred to as “Company”),
AND
The registered driver/partner (“Driver”, “You”).
By registering on Oolalala, you agree to the following terms:
12.1 Nature Of Platform
Oolalala is a technology platform that connects passengers with independent commercial taxi operators.
The Company:
- Does NOT own vehicles
- Does NOT employ drivers
- Acts only as an intermediary
12.2 Driver Status
- You are an independent contractor
- Nothing in this Agreement creates an employer-employee relationship
- You are responsible for your own business operations
12.3 Eligibility Requirements
- Valid Driving Licence (Transport category)
- Commercial Vehicle Registration (Yellow Board)
- Valid Permit (State / National)
- Valid Insurance & Vehicle Fitness Certificate
You agree to keep all documents updated at all times.
12.4 Service Obligations
- Provide safe and lawful transportation
- Maintain vehicle cleanliness and condition
- Behave professionally with riders
- Not refuse rides without valid reason
- Follow all applicable laws including the Motor Vehicles Act, 1988
12.5 Platform Usage
- Ride requests will be provided via the Oolalala app
- Driver may accept or reject requests
- Once accepted, driver must complete the ride responsibly
12.6 Pricing & Payments
- Fares may be predefined or suggested by the platform
- Payments may be collected via digital payment through platform only, or directly from customer (if enabled)
- Company may charge commission per ride or subscription fee
12.7 Commission & Fees
- Oolalala may deduct platform fees from ride payments
- Fee structure may be updated with prior notice
12.8 Cancellation Policy
- Avoid unnecessary cancellations
- Inform users in case of unavoidable delays
- Repeated cancellations may lead to penalties or suspension
12.9 Driver Responsibility
Driver is solely responsible for:
- Passenger safety
- Compliance with traffic laws
- Vehicle maintenance
- Any accidents, fines, or violations
12.10 Liability
Oolalala shall NOT be liable for:
- Accidents or injuries
- Passenger disputes
- Loss of earnings
- Legal violations by driver
Driver agrees to indemnify the Company from any claims.
12.11 Insurance
Driver must:
- Maintain valid commercial vehicle insurance
- Ensure coverage for passengers
Oolalala does not provide insurance.
12.12 Prohibited Conduct
- Using fake documents
- Misbehaviour with passengers
- Charging extra beyond the agreed fare
- Engaging in illegal activities
12.13 Suspension & Termination
Oolalala reserves the right to suspend or terminate driver account and remove access without prior notice in case of violations.
12.14 Data & Privacy
Driver agrees that data may be collected and used for platform operations, and may be shared with riders as necessary.
12.15 Governing Law
This Agreement is governed by the laws of India. Jurisdiction: Courts of Madurai, Tamil Nadu.
12.16 Modifications
Oolalala may update this Agreement at any time. Continued use of the platform implies acceptance of changes.
12.17 Acceptance
By registering on Oolalala, you confirm that you have read and understood this Agreement and agree to all terms and conditions.
Disclaimers & Limitation of Liability
To the maximum extent permitted by law, Mytouch Icon Automation LLP shall not be liable for:
- Indirect, incidental, or consequential damages (e.g., lost profits, lost data).
- Personal injury or property damage resulting from the use of the Platform.
- The acts, omissions, or conduct of any Driver or Passenger.
- Delays or failures in performance resulting from causes beyond our reasonable control (Force Majeure).
Third-Party Services
14.1 External Links
The Platform may contain links to third-party websites, services, or promotions not owned or controlled by Mytouch Icon Automation LLP. Inclusion of any link does not imply endorsement. Access to Third-Party Content is at your own risk.
14.2 Payment Gateways
Oolalala uses third-party payment processors (such as UPI, Razorpay, etc.) to facilitate payments. We do not store your banking information directly and are not responsible for any failed transactions or errors within the payment processor's system.
14.3 Map Services
The App integrates with third-party mapping services (e.g., Google Maps, Mapbox). Your use of these features is subject to the terms of service of the respective mapping providers.
Indemnity
You agree to defend, indemnify, and hold harmless Mytouch Icon Automation LLP, its affiliates, subsidiaries, officers, directors, employees, agents, and successors from and against any and all claims, demands, suits, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Platform;
- Your breach of these Terms;
- Your violation of any third-party rights or applicable laws; or
- Any dispute between you and another User.
Termination
We may restrict, suspend, or terminate your access to the Platform immediately and without notice if:
- You breach these Terms.
- We receive serious complaints about your behaviour or safety.
- You fail to maintain the required minimum balance in your Driver Wallet (for Drivers).
Upon termination, your right to use the Service will immediately cease.
Governing Law & Dispute Resolution
17.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India.
17.2 Jurisdiction
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Virudhunagar, Tamil Nadu.
17.3 Amicable Resolution
Before filing any legal action, Users agree to attempt to resolve disputes informally by contacting Oolalala Customer Support.
Changes to These Terms
18.1 Modifications to Terms
Mytouch Icon Automation LLP reserves the right to modify, amend, or replace these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Oolalala App or Website. Your continued use of the Platform after changes take effect constitutes your consent to the modified Terms.
18.2 Modifications to the Platform
We reserve the right to add, remove, or modify features within the App at our sole discretion, cease support for older App versions or operating systems, and temporarily suspend the Platform for maintenance or upgrades.
General Provisions
19.1 Severability
If any provision of these Terms is held to be illegal, invalid, or unenforceable, the remaining provisions shall continue in full force and effect.
19.2 Waiver
Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.
19.3 Assignment
You may not assign or transfer these Terms or your rights/obligations without our prior written approval. Mytouch Icon Automation LLP may assign or transfer these Terms without your consent to a subsidiary, affiliate, or a successor by merger or acquisition.
Cancellation Policy
20.1 General Policy
Oolalala operates on a confirmed booking model where payments are secured via an escrow system. Cancellation charges apply based on the timing of cancellation and booking type.
20.2 Ride Booking Cancellation
20.2.1 Customer Cancellation
- Before Driver Acceptance: 100% refund (no charges)
- After Driver Acceptance:
- More than 12 hours before trip: 90% refund (10% platform fee deducted)
- Between 12 hours to 2 hours before trip: 70% refund
- Less than 2 hours before trip: No refund
- After Trip Start (OTP shared): No cancellation allowed, No refund
20.2.2 Driver Cancellation
- If driver cancels after accepting: Penalty applied and full refund to customer
- Repeated cancellations may lead to account suspension or deactivation
20.3 No-Show Policy
- Customer No-Show: No refund, full amount charged
- Driver No-Show: Full refund to customer, penalty applied, possible suspension
20.4 Tour Booking Cancellation
20.4.1 Customer Cancellation
- More than 48 hours before tour: 85% refund (15% deduction)
- 24–48 hours before tour: 50% refund
- Less than 24 hours before tour: No refund
20.4.2 After Tour Start
No cancellation allowed. No refund.
20.5 Refund Processing
- Refunds will be processed within 5–7 working days
- Amount will be credited to original payment method
20.6 Special Conditions
- In case of natural disasters, government restrictions, or verified emergencies, Oolalala may provide partial or full refunds at its discretion
20.7 Platform Charges
- Commission, GST, and payment gateway charges may be non-refundable in certain cases
20.8 Dispute Resolution
- All disputes must be reported within 24 hours of trip completion
- Oolalala reserves the right to investigate and make the final decision
20.9 Policy Updates
Oolalala reserves the right to modify this policy at any time without prior notice.
